1. Terms

By accessing the website at tocavpn.com or using the TocaVPN applications, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site and the TocaVPN applications. The materials contained in this website and our applications are protected by applicable copyright and trademark law.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on TocaVPN's website and applications for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • modify or copy the materials;
  • use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
  • attempt to decompile or reverse engineer any software contained on TocaVPN's website or in its applications;

In no event shall TocaVPN or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on TocaVPN's website or applications, even if TocaVPN or a TocaVPN authorized representative has been notified orally or in writing of the possibility of such damage. However, TocaVPN does not make any commitment to update the materials.

TocaVPN has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by TocaVPN of the site. Use of any such linked website is at the user's own risk.

7. Modifications

TocaVPN may revise these terms of service for its website and applications at any time without notice. By using this website or our applications you are agreeing to be bound by the then current version of these terms of service.

8. Acceptable Use

By using our website and/or applications, you furthermore agree to the following and/or the following applies:

  • TocaVPN is not a service to be used for criminal acts. You are forbidden to use it for criminal acts.
  • You accept not to violate any law of any jurisdiction that you are originating from.
  • It is your responsibility to know and comprehend any and all relevant laws related to any jurisdiction or venue that concerns you and your actions.
  • TocaVPN will not be liable in any way or form for actions done by its users, including any criminal or civil liability for harm executed or not executed, beyond any money paid to TocaVPN for its services by a concrete individual.
  • You agree to keep any TocaVPN account or device credentials secure and to prevent unauthorized usage.
  • You are responsible for every action that occurs on TocaVPN where your account or device was used to establish the VPN connection.
  • You agree not to use our services for port scanning, sending spam, sending unsolicited e-mail (including opt-in or bulk e-mail, even if ultimately routed through another server), scanning for open relays or open proxies, launching pop-ups, or attacking any other network or computer.
  • TocaVPN is intolerant of the exploitation of children photographically, digitally or in any other way.
  • TocaVPN, its owners, employees, agents and others involved with TocaVPN services are not in any way liable for any harm of any sort executed or not executed, resulting or arising through or from the use of any account or connection on TocaVPN services.

9. Subscriptions, Billing & Refunds

TocaVPN Premium is offered as an auto-renewing subscription sold through the Apple App Store and Google Play. By purchasing a subscription, you agree to the following:

  • Payment is charged to your App Store or Google Play account at confirmation of purchase.
  • Subscriptions renew automatically for the same period and price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • You can manage or cancel your subscription at any time in your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period; no partial-period refunds are provided.
  • Refunds for store purchases are handled exclusively by Apple and Google under their respective policies. TocaVPN cannot directly issue refunds for purchases made through these stores. Refund requests should be submitted via Apple — Request a refund or Google Play refund policy.
  • EU/UK right of withdrawal: by starting to use the digital service immediately upon purchase, you expressly consent to the immediate performance of the contract and acknowledge that you lose your statutory 14-day right of withdrawal under the EU Consumer Rights Directive and equivalent UK law.

10. Age Restriction

The Service is not directed to and may not be used by anyone under the age of 16. By using TocaVPN, you represent that you are at least 16 years old. If you are a parent or guardian and become aware that a person under 16 has used the Service, please contact support@tocavpn.com so we can remove any associated data.

11. Fair Use Policy

TocaVPN reserves the right to terminate a user's connection or access to its services if the user shares login information with others, or if their usage is materially above common consumption.

12. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of England and Wales, and you irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.
